Terms & Conditions

These Terms and Conditions govern the use of services provided by LocalPages.au, operated by Ricardo Schmidt ("we", "us", "our"). By purchasing or using our services, you agree to these Terms.

1. Our Services

LocalPages.au provides:

• Creation and hosting of professional single-page websites for local businesses
• Ongoing website maintenance while your subscription is active
• Limited content updates as included in your plan
• Optional custom domain setup under the Pro plan

Definition of "Single-Page Website"

A "single-page website" as provided by LocalPages.au consists of one scrollable webpage that may include the following sections (not all sections are necessarily included; sections will depend on customer requirements and industry):

• About Us section
• Services section
• Location map (embedded)
• Gallery (up to 10 photos)
• Get in Touch (Contact form, phone, location, email, etc.)
• Business Hours
• What Our Clients Say (testimonials)
• Frequently Asked Questions
• Service Areas
• Basic SEO meta tags
• One main hero section
• Professional layout, mobile-friendly design

The specific sections included will be determined based on your business type, industry requirements, and information provided or publicly available.

Websites may be created using information you provide and/or publicly available business listings.

Service Level: We aim for 99.9% uptime but are not liable for outages caused by third-party providers (AWS, Stripe, domain registrars, or DNS services).

2. Plans & Pricing

Standard Plan

• $49 AUD per month, or
• $490 AUD per year

Includes:

• Hosted single-page website
• Subdomain address: localpages.au/your-business
• Secure HTTPS hosting
• 3 content updates per year

Content updates include: text changes, contact detail updates, service list modifications, or image replacements. Major redesigns are not included.

Pro Plan

• $59 AUD per month, or
• $590 AUD per year

Includes everything in Standard, plus:

• Custom domain connection (e.g. yourbusiness.com.au)

Domain registration and renewal fees are charged annually, are not included in the subscription price, and are billed separately via Stripe.

Prices may change in the future with reasonable notice.

3. Payments & Billing

• All payments are processed securely via Stripe.
• Subscriptions are billed automatically at the start of each billing period.
• By subscribing, you authorise LocalPages.au to charge your nominated payment method on a recurring basis.
• Failed payments may result in temporary suspension or permanent removal of your website.

4. Cancellations & Refunds

• You may cancel your subscription at any time.
• No refunds are provided for partial billing periods.
• Your website will remain active until the end of your paid billing cycle.
• After cancellation or non-payment, your website will be taken offline.
• Upon request before cancellation, we will provide you with a copy of your website files (HTML/images) for a $50 export fee.

5. Website Content & Accuracy

• You retain ownership of your business name, branding, and supplied content.
• You grant LocalPages.au permission to display your business name, phone number, email, location, and services.
• You are responsible for ensuring all supplied or approved information is accurate, lawful, and not misleading.

We reserve the right to remove or edit content that is illegal, offensive, misleading, or in breach of Australian law.

6. Domain Names

• Under the Pro plan, a custom domain may be registered on your behalf.
• Domain registration and renewal fees are charged annually, are not included in your subscription, and are billed separately via Stripe.
• Domain prices vary based on availability, registrar pricing, and domain extension (.com.au, .net.au, etc.)

Domain Ownership:

• Domains are registered in your business name.
• LocalPages.au maintains administrative access for DNS management during your active subscription.
• You may request full administrative transfer at any time for a $50 administration fee.
• We are not responsible for outages or DNS failures caused by third-party registrars.

7. Service Guarantees

We guarantee your website will be:

• Professionally designed
• Functional and accessible online
• Mobile-responsive
• Hosted securely with HTTPS

However, we do not guarantee specific business outcomes such as:

• Enquiries or leads
• Sales or revenue
• Search engine rankings
• Business growth or traffic

8. Acceptable Use

You may not use LocalPages.au services for:

• Illegal activities
• Adult or sexually explicit content
• Gambling or betting services
• Pyramid schemes or multi-level marketing
• Misleading or deceptive advertising
• Hate speech, harassment, or discrimination

We reserve the right to immediately terminate services for violations without refund.

9. Suspension or Termination

We may suspend or terminate services if:

• Payments are overdue
• These Terms are breached
• Your business operates unlawfully
• You violate the Acceptable Use policy

10. Limitation of Liability

To the maximum extent permitted under Australian Consumer Law:

• We are not liable for indirect or consequential losses.
• Our total liability for any claim is limited to the fees paid by you in the three (3) months immediately preceding the claim.

11. Australian Consumer Law

Nothing in these Terms excludes or restricts your rights under the Australian Consumer Law (ACL). If we fail to deliver services as promised, you may be entitled to a refund or remedy under the ACL.

12. Changes to These Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance of any updates.

13. Disputes

Before taking legal action, you agree to:

• Notify us in writing at support@localpages.au
• Allow 14 days to resolve the issue

All disputes will be governed by the laws of New South Wales, Australia.
